Case Study: Investigation and Compliance Review Following a Heavy Vehicle Incident

Client Context

A Queensland Government Department (name withheld) required an independent workplace investigation into a serious heavy vehicle incident. The review needed to address workplace health and safety obligations, Heavy Vehicle National Law (HVNL) Chain of Responsibility (CoR), and transport compliance requirements.


Project Overview

Organisational Risk Consulting (ORC) was engaged to provide an impartial, evidence-based investigation. The engagement was particularly complex due to the elapsed time since the incident, issues with accessing the vehicle, and differing stakeholder expectations.


The investigation was designed to establish the facts of the incident, assess compliance against legal obligations, and provide leaders with practical recommendations to strengthen safety governance and reduce future risks.

  

Our Approach

ORC adopted a structured and independent methodology to deliver clarity and confidence to senior leaders:

  • Scene Visit: Conducted an on-site inspection to review road conditions and signage, despite the incident occurring several months earlier.
  • Documentation Review: Examined internal investigation reports, training and induction records, safe work procedures, and HVNL CoR documentation.
  • Stakeholder Interviews: Undertook factual interviews with relevant parties to capture multiple perspectives.
  • Factual Reporting: Prepared and presented a comprehensive investigation report with evidence-based findings and actionable recommendations.

The investigation delivered significant value by:

  • Providing a clear, evidence-based understanding of the incident.
  • Highlighting gaps in the safety management system linked to compliance with WHS and HVNL obligations.

 The investigation required careful navigation of several complexities:

  • Time-lapse: The incident had occurred several months earlier, requiring careful reconstruction of events and validation of information. 
  • Access to the Vehicle: Securing access to the wreckage at its storage location was challenging. 
  • Cross-Departmental Dynamics: Information-sharing across multiple teams presented challenges, requiring sensitivity and persistence to ensure evidence was gathered effectively. 
  • Preconceived Opinions: Stakeholders had differing views on the likely outcome. ORC diplomatically presented factual findings, ensuring acceptance and credibility.

This engagement highlights ORC’s expertise in conducting impartial investigations and compliance reviews, even under complex circumstances.
